Latest Position Regarding Local Land Charges Register
Information
Further to the Government's instruction that the
fee for a personal search in the Register has been revoked and in
view of the fact that we have not received, as yet, any further
information relating to any other proposed changes to the provision
of the property search Wychavon would advise of the following:-
- his authority will be permitting free
inspection of the Local Land Charges Register from 17 August
2010. The information is now published on our web site.
Requests to inspect environmental data which is not on the
LLC Register will be dealt with separately and in accordance with
the Environmental Information Regulations (“EIR”), i.e. inspection
will be permitted unless it is reasonable to provide access in an
alternative format.
- As and when arrangements for accessing data are
altered we shall publicise this on our website. Please note that it
is not necessarily the case that if an official search can be
provided within 2 working days then any request for access to the
same data must be provided within 2 working days. The timescales by
which access can be provided under a personal search will depend on
the data requested and the manner in which it is to be accessed
(i.e. inspection or copies).
- It is permissible to make notes when inspecting
environmental data in situ.
- The EIR permit a reasonable charge to be
made for the supply of environmental information. Therefore, if you
request copies of entries on the LLC Register or other
environmental data by way of letter, these will be supplied and
charged for in accordance with the EIR, i.e. the charges will not
exceed an amount which the authority is satisfied is a reasonable
amount [Regulation 8(3)].

A Guide To Local Land
Charges
A Local Land Charge Search forms an important part of the
Convenancing Process your Solicitor carries out when you purchase a
property. Your Solicitor will guide you through the process, one
element of which is the Local Land Charge Search.
A standard search LLC1 and Con29R is £108.00 which comes with
the assurance and insurance that all responses have been
investigated and authenticated by the Local Authority and signed by
the Proper Officer
Local Land Charges were the creation of the Land Charges Act
1925 and were set up to make new purchasers aware of any
enforceable obligations that were binding on successive owners. The
principle is still the same today although changes have taken place
with regard to the Statues, Rules and Acts which govern the
Register.
The Register is split into twelve parts as
follows:
- Parts I and II - Financial
- Part III - Planning
- Part IV - Miscellaneous
- Part V - Fenland
- Part VI - Land Compensation
- Part VII - New Towns
- Part VIII - Civil Aviation
- Part IX - Opencast Coal
- Part X - Listed Buildings
- Part XI - Light Obstruction Notices
- Part XII - Drainage Schemes
