HMO Licensing
HMO licensing commenced on 6th April 2006. Certain
high risk HMO’s are required to be licensed by the Council and
failure to obtain a licence could lead to a fine up to £20,000.
Which HMO’s Require Licensing?
- HMO’s with 3 or more storeys and 5 or more occupants who
together do not form a single household.
- This does not include Section 257 HMO’s (for definition please
see above)
Storeys include:
- Those which are occupied by a business (if its above and below
a HMO)
- Mezzanine floors (unless only used to gain access from one
floor to another)
- Storeys with in the HMO that are currently not in use.
- Attics including lofts:
- That are
wholly or partly used as residential accommodation
- If it has
been constructed, converted or adapted for wholly as
use residential accommodation (even if its not currently
in use)
- Or is
an integral part of the HMO such as a communal room or
storage
facilities.
- That are
wholly or partly used as residential accommodation
Attics
including
lofts:
- Basements that:
- Are used wholly or partly as living accommodation
- If it has been constructed, converted or adapted for wholly use
as
residential accommodation (even if its not
currently in use)
- Or is an integral part of the HMO such as a communal room or
storage
facilities.
- Is the only or principle access to the HMO from the street.
How to Apply for a Licence
If you think that your property should be licensed
please contact the Private Sector Housing Team on 01386 565341 or
privatesectorhousing@wychavon.gov.uk.
Alternatively please complete the application form below and
send it into the Department. The fee for a licence from 1
April 2012 will be £510.00, each licence will last for five
years.
