Parking Enforcement and the legislation we work under

The Traffic Management Act 2004 was introduced on the 31st March 2008 and is the legislation that we enforce under. In conjunction with this there is the new amendment to the Act cited as the Civil Enforcement of Parking Contraventions (England) General (Amendment) Regulations 2015 which came into force on 6th April 2015.

The 2004 TMA made several changes to the previous legislation. The name of the officers changed to Civil Enforcement Officers, it added several new contraventions and it enables issue of postal Penalty Charge Notices (PCN's) in certain circumstances, such as the Civil Enforcement Officer being threatened or the vehicle being driven away.  In these cases there will no longer be a need for a Penalty Charge Notice to be placed on a vehicle or handed to the driver in order for it  be served legally.  Whilst the Traffic Management Act 2004 allows a Penalty Charge Notice to be posted to the registered keeper of the vehicle the majority of Penalty Charge Notices will be placed on the vehicle windscreen as before.

The Civil Enforcement of Parking Contraventions (England) General (Amendment) Regulations 2015 which came into force on the 6th April 2015 deals with grace periods. It is now a legal requirement that a period of 10 minutes is given to a vehicle parked in a car park with an expired P&D ticket or a paid for bay On-Street with an expired ticket (we do not have any paid On-Street parking in Wychavon). It is now a requirement to allow a period of 10 minutes prior to issuing a Penalty Charge Notice to vehicles that have overstayed in On-Street limited waiting bays.

All other contraventions have remained the same before.

Penalty Charge Levels

The following charges will be in place from 31st March 2008 for a Penalty Charge Notice issued under the Traffic Management Act 2004. The amount payable on Penalty Charge Notice is dependent on the severity of the contravention. Please see the list of parking contraventions and the relevant penalty that will be incurred.
