For us to provide legal services, we need to collect and hold personal information. This notice explains what information we hold and how we will use it.

Personal Data held by Legal Services

Personal data collected and held by Legal Services may include:

  • basic personal information such as name, address, telephone number, email 
    address.
  • Financial Information.
  • Personal information held in relation to a Court claim or prosecution, such as evidence obtained as part of an investigation.

Who is processing my data?

All personal data held is processed in accordance with data protection law. The Data Controllers for the information outlined in this privacy notice are Wychavon District Council and Malvern Hills District Council, as Legal Services is a shared team across the two authorities.

How will we use the Information we hold about you?

We will collect information about you, where applicable, for the following reasons.

  • To draft legal agreements such as S106 agreements, leases, licences and 
    contracts;
  • For the purpose of legal proceedings such as civil claims or prosecutions;
  • To deal with your application for a Road Closure Order, Freedom of Information request, Subject Access Request, Footpath Diversion;
  • In order to respond to enquiries made of us

What is the legal basis for us to process your data?

The legal basis for processing the data is as follows:

  • carrying out of a contract to which you are a party
  • in the public interest or in the exercise of official authority

We may share your information with partner organisations, including:-

  • Other Public Bodies, including the Courts and Tribunal Service

We will not normally share your information with organisations other than our partner organisations without your consent, however, there may be certain circumstances where we would share without consent such as where we are required to do so by law, to safeguard public safety, and in risk of harm or emergency situations.

Any information which is shared will only be shared on a need to know basis, with appropriate individuals. Only the minimum information for the purpose will be shared.

How Long do we Keep your Records

We will only keep your information for the minimum period necessary. The information outlined in this privacy notice will be kept in accordance with our retention schedule. All information will be held securely and destroyed under confidential conditions.

Personal data held by Community Services

In order to provide community services, it is necessary for us to collect and hold personal information. This information may include:

  • Basic personal information such as name, address, telephone number, email address
  • Financial information
  • Photographs and film images of individuals
  • CCTV surveillance data
  • Details about your vehicle and its location

Who is processing your data?

All personal data held is processed in accordance with data protection law. For Community Services purposes, Malvern Hills District Council is the data controller.

Why do we collect your information?

We collect your data in order to:

  • Meet statutory requirements e.g. reporting to Government
  • Monitor service improvement and planning e.g. in relation to activities and programmes delivered by Community Services
  • Undertake Financial transactions
  • Conduct research including consultations
  • Contact you with relevant Communications and Marketing such as in relation to activity programmes
  • Issue Fixed Penalty Notices in relation to environmental offences
  • Issue Community Protection Warnings and Notices in relation to anti social behaviour offences
  • Ensure the safeguarding of vulnerable residents

  • Collect nominations and feedback for Council Lead Awards

What is the legal basis for us to process your data?

The legal basis for processing the data is:

Where we have collected your personal data such as contact details for marketing purposes, we require your consent to hold this. You can withdraw your consent for us to process your data for these purposes.

Where we have retained your photographic or filmed images for marketing or promotional purposes, we will have obtained your consent to do so. You have the right to withdraw your consent for us to hold these images.

Privacy notice for CCTV and Body Worn Cameras

Personal Data held by Malvern Hills District Council and Wychavon District Council.

The Authorities have installed CCTV systems in some of its locations used by members of the public. In all locations, signs are displayed notifying you that CCTV is in operation and providing details of who to contact for further information about the scheme. Where an officer is wearing a body camera, this will be indicated with signage on their person. The personal data collected will be recorded images of identifiable individuals, and in some circumstances, audio recordings.

How we use the information we hold about you?

CCTV and associated systems will only be used to assist with the following objectives:

  • to help deter crime, detect crime and prevent crime;
  • to deter and detect anti-social behaviour;
  • to assist in the apprehension and identification of offenders;
  • to enhance community safety;
  • to assist the Local Authority in its enforcement and regulatory functions;
  • for the maintenance of Public Order;
  • protecting property
  • providing assistance with issues relating to public safety and health
  • providing assistance and reassurance to the public in emergency situations

What is the legal basis for us to process your data?

The legal basis for processing is for the performance of a task carried out in the public interest or in the exercise of official duty vested in the Data Controller, for the purposes of public safety and prevention and detection of crime under various UK laws but not limited to: The Criminal Justice & Public Order Act 1994, The Environmental Protection Act 1990, The Anti-Social Behaviour Act 2003, The Children Act 2004, The Traffic Management Act 2004, The Clean Neighbourhoods and Environment Act 2005, The Localism Act 2011, The Anti-Social Behaviour Police and Crime Act 2014.

Who do we share your information with?

We may provide the police and other agencies with evidence to take criminal and civil action.

Wychavon District Council and Malvern Hills District Council will only disclose CCTV images to others who intend to use the images for the purposes stated above. Evidence production is only available in limited circumstances upon request. How long do we keep your records?

Images captured by CCTV will not be kept for longer than 31 days. However on occasion there may be a need to keep images for longer, for example, where a crime is being investigated. The system will be operated in accordance with the Surveillance Camera Code of Practice issued by the Secretary of State in 2013.

Privacy Notice for Electoral Services

To organise elections and referendums and compile the Register of Electors we hold personal data about you.

Personal data held by Electoral Services 

The law makes it compulsory to provide information to an electoral registration officer for inclusion in the full register. We keep records about potential and actual electors, voters, candidates and their agents and staff employed for elections.

This information may include:

  • basic personal information such as your name, address, telephone number, email address, National Insurance Number.
  • unique identifiers (such as National insurance Number). Signatures for absent vote checking.
  • scanned application forms, documentary evidence, dates of any letters of correspondence.
  • notes about any relevant circumstances that you have told us.
  • your previous or any redirected address.
  • If you are over 76 or 16/17 years of age.
  • Whether you have chosen to opt out of the open version of the register.
  • details about your household composition.

Who is processing my data?

All personal data held, is processed in accordance with data protection law. The Electoral Registration Officer is the Data Controller: Vic Allison, Wychavon District Council, Queen Elizabeth Drive, Pershore, Worcs, WR10 1PT.

How will we use the Information we hold about you?

We will collect information about you where applicable:

  • Organising all types of elections and referendums within Wychavon.
  • Compiling and maintaining the Register of Electors.
  • Dealing with monthly registrations to be included on the register and applications to vote by post.
  • Boundary and community governance reviews and electoral arrangements.
  • Promoting participation in our democratic processes.

What is the legal basis for us to process your data?

The legal basis for processing the data is

  • It is necessary for the performance of a task carried out in the public interest and exercise of official authority as vested in Electoral Registration Officer to comply with the Electoral Registration and Administration Act 2013 and the Representation of the People Act 1983 and associated regulations.

Who we will share your information with

The information you provide is held in electoral registers which are managed by  electoral registration officers who, using information received, keeping two registers – the full electoral register and the open (edited) register.
The full register is published once a year and is updated every month and can only be supplied to the following people and organisations:

  • The Electoral Commission
  • British Library
  • UK Statistics Authority
  • Boundary Commission for England
  • Jury Summoning Bureau
  • Elected Representatives (MP, MEPS, Local Councillors)
  • Police and Crime Commissioner
  • Candidates standing for elections
  • The Council
  • Parish and Community councils
  • Police Forces, National Crime Agency
  • Government departments or bodies
  • Credit Reference Agencies
  • Electoral Registration and Returning Officers

We also must disclose (share) your information with our Software Providers and contracted printers. It is a crime for anyone who has a copy of the full register to pass information form this register on to others if they do not have a lawful reason to see it.

Anyone can inspect the full electoral register.

  • Inspection of the register will be under supervision.
  • They can take extracts from the register, but only had written notes.
  • Information taken must not be used for direct marketing purposes, in accordance with data protection legislation, unless it has been published in the open version.
  • Anyone who fails to observe these conditions is committing a criminal offence and will be charged a penalty of up to £5,000.

The open register contains the same information as the full register but is not used for elections or referendums. It is updated and published every month and can be sold to any person, organisation, or company for a wide range of purposes. It is used by businesses and charities for checking names and address details; users of the register include direct marketing firms and online directory firms.

You can choose whether to have your personal details include in the open version of the register, however, they will be included unless you ask for them to be removed. 
Removing your details from the open register will not affect your right to vote
There may be certain circumstances where we would share your details without consent such as where we are required to do so by law, to safeguard public safety, and in risk of harm or emergency situations. Any information which is shared will only be shared on a need-to-know basis, with appropriate individuals. Only the minimum information for the purpose will be shared.

Employee Privacy Statement

The council collects and processes personal data relating to its employees to manage the employment relationship. The council is committed to being transparent about how it collects and uses that data and to meeting its data protection obligations.

What information does the council collect?

The council collects and processes a range of information about you. This includes:

  • your name, address and contact details, including email address and telephone number, date of birth and gender;
  • the terms and conditions of your employment;
  • details of your qualifications, skills, experience and employment history, including start and end dates, with previous employers and with the council;
  • information about your remuneration, including entitlement to benefits such as 
    pensions or insurance cover;
  • details of your bank account and national insurance number;
  • details of your car make, model and registration number as well as the latest MOT and insurance certificate (if you claim mileage). Also driving licence information;
  • information about your marital status, next of kin, dependants and emergency 
    contacts;
  • information about your nationality and entitlement to work in the UK;
  • information about your criminal record;
  • details of your schedule (days of work and working hours) and attendance at 
    work;
  • details of periods of leave taken by you, including holiday, sickness absence, family leave and sabbaticals, and the reasons for the leave;
  • details of any disciplinary, capability or grievance procedures in which you have been involved, including any warnings issued to you and related correspondence;
  • assessments of your performance, including performance development reviews, performance improvement plans and related correspondence;
  • information about medical or health conditions, including whether or not you have a disability for which the council needs to make reasonable adjustments;
  • equal opportunities monitoring information including information about your ethnic origin, sexual orientation and religion or belief; and any other personal information obtained as a result of your contact with us and/or your employment with the Council.

The council may collect this information in a variety of ways. For example, data might be collected through application forms or CVs; obtained from your passport or other identity documents such as your driving licence; from forms completed by you at the start of or during employment (such as benefit nomination forms); from correspondence with you; or through interviews, meetings or other assessments.

In some cases, the council may collect personal data about you from third parties, such as references supplied by former employers, information about previous local government service and information from criminal records checks permitted by law. 

Data will be stored in a range of different places, including in your personnel file, in the council's HR management systems and in other IT systems (including the council's email system).

Why does the council process personal data?

The council needs to process data to enter into an employment contract with you and to meet its obligations under your employment contract. For example, it needs to process your data to provide you with an employment contract, to pay you in accordance with your employment contract and to administer benefit and pension entitlements and to process and pay appropriate expenses.

In some cases, the council needs to process data to ensure that it is complying with its legal obligations. For example, it is required to check an employee's entitlement to work in the UK, to deduct tax, to comply with health and safety laws and to enable employees to take periods of leave to which they are entitled.
In other cases, the council has a legitimate interest in processing personal data before, during and after the end of the employment relationship. Processing employee data allows the council to:

  • run recruitment and promotion processes;
  • maintain accurate and up-to-date employment records and contact details (including details of who to contact in the event of an emergency), and records of employee contractual and statutory rights;
  • operate and keep a record of disciplinary and grievance processes, to ensure 
    acceptable conduct within the workplace;
  • operate and keep a record of employee performance and related processes, to plan for career development, and for succession planning and workforce management purposes; operate and keep a record of absence and absence management procedures, 
    to allow effective workforce management and ensure that employees are receiving the pay or other benefits to which they are entitled;
  • obtain occupational health advice, to ensure that it complies with duties in relation to individuals with disabilities, meet its obligations under health and safety law, and ensure that employees are receiving the pay or other benefits 
    to which they are entitled;
  • operate and keep a record of other types of leave (including maternity, paternity, adoption, parental and shared parental leave), to allow effective workforce management, to ensure that the council complies with duties in relation to leave entitlement, and to ensure that employees are receiving the pay or other benefits to which they are entitled;
  • ensure effective general HR and business administration;
  • provide references on request for current or former employees;
  • provide continuous service dates for current or former employees and
  • respond to and defend against legal claims taken against the council, or provide evidence in relation to any claims brought by the council.

Some special categories of personal data, such as information about health or medical conditions, is processed to carry out employment law obligations (such as those in relation to employees with disabilities).

Where the council processes other special categories of personal data, such as information about ethnic origin, sexual orientation or religion or belief, this is done for the purposes of equal opportunities monitoring. This is to carry out its obligations and exercise specific rights in relation to employment.

Who has access to data?

Your information may be shared internally, including with members of the HR and payroll team, your line manager, managers in the business area in which you work and IT staff if access to the data is necessary for performance of their roles.

The council shares your data with third parties in order to obtain pre-employment references from other employers, obtain employment background checks from third party providers and obtain necessary criminal records checks from the Disclosure and Barring Service. The council may also share your data with third parties in the context of a sale of some or all of its business, or for provision of employment references for former employees. In those circumstances the data will be subject to confidentiality arrangements.

The council also shares your data with third parties that process data on its behalf, in connection with the provision of benefits such as the Local Government Pension Scheme, childcare vouchers and the provision of occupational health services, who conduct pre-employment medical checks as appropriate and occupational health referrals.

The council will not transfer your data to countries outside the UK.

How does the council protect data?

The council takes the security of your data seriously. The council has internal policies and controls in place to try to ensure that your data is not lost, accidentally destroyed, misused or disclosed, and is not accessed except by its employees in the performance of their duties.

Where the council engages third parties to process personal data on its behalf, they do so on the basis of written instructions, are under a duty of confidentiality and are obliged to implement appropriate technical and organisational measures to ensure the security of data.

For how long does the council keep data?

The council will hold your personal data for the duration of your employment. The periods for which your data is held after the end of employment are set out in the council’s document retention schedule which can be found on the staff intranet.

Your rights

As a data subject, you have a number of rights. You can:

  • access and obtain a copy of your data on request;
  • require the council to change incorrect or incomplete data;
  • require the council to delete or stop processing your data, for example where the data is no longer necessary for the purposes of processing; and
  • object to the processing of your data where the council is relying on its legitimate interests as the legal ground for processing.

If you believe that the council has not complied with your data protection rights, you can complain to the Information Commissioner.

What if you do not provide personal data?

You have some obligations under your employment contract to provide the council with data. In particular, you are required to report absences from work and may be required to provide information about disciplinary or other matters under the implied duty of good faith. You may also have to provide the council with data in order to exercise your statutory rights, such as in relation to statutory leave entitlements. Failing to provide the data may mean that you are unable to exercise your statutory rights.

Certain information, such as contact details, your right to work in the UK and payment details, have to be provided to enable the council to enter a contract of employment with you. If you do not provide other information, this will hinder the council's ability to administer the rights and obligations arising as a result of the 
employment relationship efficiently
